A U.S. federal judge has thrown out a cryptocurrency investor lawsuit against billionaire entrepreneur Mark Cuban and the NBA\u2019s<\/a> Dallas Mavericks, ruling that the case was filed in the wrong place. The decision ends\u2014at least for now\u2014a class-action effort tied to the collapse of crypto lender Voyager Digital.<\/h2>\n\n\n\n

On Friday, Judge Roy K. Altman of the U.S. District Court for the Southern District of Florida dismissed the lawsuit after finding that the plaintiffs failed to establish personal jurisdiction in Florida. In simple terms, the court said there wasn\u2019t a strong enough legal link between the defendants and the state to justify hearing the case there.<\/p>\n\n\n\n

The lawsuit, first filed in 2022, accused Cuban and the Mavericks of promoting Voyager\u2019s crypto products using their public influence. Investors claimed those promotions encouraged people to use the Voyager platform and contributed to financial losses when the company later went bankrupt. The case was one of many lawsuits targeting celebrities, athletes, and sports organizations that promoted crypto firms during the market boom.<\/p>\n\n\n\n

However, the judge made it clear that the ruling did not examine whether the promotions themselves were misleading or improper. Instead, the dismissal was based purely on jurisdiction. According to the court, national marketing campaigns, press conferences, and app promotions available online do not automatically mean that Florida residents were specifically targeted under the state\u2019s long-arm statute or constitutional due-process rules.<\/p>\n\n\n\n

Because of that, the case was dismissed without prejudice, meaning the plaintiffs are free to refile the lawsuit in another jurisdiction if they choose.<\/p>\n\n\n\n

As part of their argument, investors pointed to comments Cuban made during an October 2021 Dallas Mavericks press conference, where he said he had personally invested in Voyager. The lawsuit also highlighted a Mavericks promotion that offered $100 worth of Bitcoin to fans who downloaded the Voyager app, opened an account, deposited $100, and completed a trade.<\/p>\n\n\n\n

Cuban\u2019s legal team pushed back, arguing that neither Cuban nor the Mavericks specifically targeted Florida residents. Court filings also noted that Cuban had publicly warned people to be cautious with their money when discussing cryptocurrency investments.<\/p>\n\n\n\n

Brown Rudnick, the law firm representing Cuban and the Mavericks, welcomed the ruling. The firm said the court rejected the idea that broad national advertising alone is enough to establish jurisdiction in any state where an investor claims losses. Lead counsel Steve Best said the decision was the \u201cabsolute right result,\u201d adding that Cuban is prepared to fight the claims in any venue if the case is refiled.<\/p>\n\n\n\n

Voyager Digital filed for Chapter 11 bankruptcy protection in July 2022 after suffering heavy market losses and counterparty failures. At its peak in 2021, the company reported more than $5 billion in assets and nearly 3.5 million customers. Its collapse continues to spark legal battles that test how far liability can extend in crypto marketing and celebrity endorsements.<\/p>\n\n\n\n

Separately, Cuban sold his majority stake in the Dallas Mavericks to casino executive Miriam Adelson in late 2023, though he retained a minority ownership and remains involved in basketball operations.<\/p>\n\n\n\n
